When you download the Rockingham Insurance Safe Driving Application (the “App”) and enable your permissions, we use the App to obtain telematics data collected by your phone to measure your safety behind the wheel for the purposes of studying and evaluating the functionality and useability of the App as part of a Pilot Program to help Rockingham Insurance develop future products.

What you need to know

We take protecting your data very seriously. This means we never sell your personally identifiable data (things like name, address, and driver’s license number). Any sensitive information that is submitted to us is sent securely using encryption.

This Privacy Policy discloses the Rockingham Insurance Company (“Rockingham,” “us,” “we,” or “our”) privacy practices for the Rockingham Insurance Safe Driving Mobile Application (the “App”) Pilot Program. This Privacy Policy applies to information collected by the App, and is intended to generally notify you of the following:

• What information we collect
• How we use and share your information
• How we secure and retain your information
• Your options and choices

All information collected through or in connection with this App is subject to our Privacy Policy and the Privacy Policy of our licensors and service providers, including Root.  By using the App, you agree to our Privacy Policy and the collection and use of information contemplated by its terms. Our Privacy Policy applies to information we collect from all sources. If you feel that we are not abiding by this privacy policy, you should contact us immediately at care@rockingham.insure.

What information we collect

You have granted us permission through the Mobile Application End User License and Pilot Program Participation Agreement (https://rockingham.insure/mobile-application-end-user-license/) to collect and use certain information as part of the Pilot Program. For users of the App, we gather non-public personally identifiable information from you and from outside business partners for the business purpose of this App Pilot Program. This nonpublic personally identifiable information we collect from you includes your:

• E-mail address
• Internet Protocol (IP) Address
• Details about the type of cell phone / cell phone operating system
• Data via GPS when trips are being tracked
• Device ID for the cell phone
• The above information may link to your name, phone number or other personally identifiable information.

We will also gather certain telemetric data, such as, accelerometer, GPS and gyroscope data off of your mobile device.  The Application will collect information regarding your vehicle trips such as the date of each individual trip, the trip duration, the trip distance and total trip count along with other information on how you use your Mobile Device when behind the wheel.  The App will continue to monitor your device activity until you otherwise change your permissions.

Additionally, the App and/or our business partners gather information through internet activity, which may include, for example, your operating system, mobile device identification and/or advertising identification number, your phone carrier and interactions with other features within the mobile device while the App is installed.

Also note that because the App incorporates Google Maps/Google Earth, you are also bound by the Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy.

How we use and share your information from the App

• We collect information that you voluntarily give us via sign-on process or other direct contact from you.
• Collected information will be used by the Application to create a score model and score value for each Participant, which will be used by Rockingham and Rockingham’s licensors and service providers for purposes of this Pilot Program.
• This information will be collected by Rockingham to determine useability and functionality of the Application to assist Rockingham in determining whether it wants to offer usage-based insurance products to its customers following the conclusion of the Pilot Program.
• No collected data during the Pilot Program will be used for rating or underwriting purposes, now or in the future, nor will any information be shared with your current auto insurance company if you are not insured with Rockingham.
• We may use, share, disseminate, or sell aggregated, anonymized data of consumers. This data cannot be reasonably traceable to any individual.
• Unless you ask us not to, we may contact you via email, regular mail, and via push notification in the App with promotions in the future to tell you about specials, new products or services, or changes to this Privacy Policy.
• The App gathers and combines data from the mobile device for the purpose of analysis and risk evaluation.
• Data collected by the App may be disclosed to third parties as required by law or regulation.
• Data collected by the App from your mobile device may be deemed discoverable by third parties and used in an accident investigation, claims, and/or litigation.
• The App may be legally required to provide the data to others and ⁄or their legal counsel, and you should not expect to retain data privacy or confidentiality.
• At our discretion, telematics can be utilized in the investigation of a claim or for any other lawful purposes.
• We may provide certain information to insurance regulators as required or necessary to support our business or this Pilot Program.
• We will share your information with business partners as necessary as part of the Pilot Program. This would be done as required or permitted by law. For example, we may do this to:
  • Prevent fraud
  • Comply with requests from regulatory and law enforcement authorities
  • Send you push notifications
  • The persons or organizations with whom we may share your information may include, among others:
  • Business partners that assist us with tracking driving behavior, scoring, and usage
  • A business or businesses that conduct actuarial or research studies
  • Those who request information pursuant to a subpoena or court order

How we secure and retain your information

Rockingham takes precautions to protect your information. Any information that is submitted via the App is protected both online and offline.

Any personally identifiable information that our employees have access to will be encrypted in a secure way. All employees are prohibited from using or disclosing information collected by the App for any purpose other than performing their work in connection with this Pilot Program and determining the usability and functionality of the App.

Your options and choices

Review or correct your information. You can request to review personally identifiable information you have provided to Rockingham. This does not include information about you that was provided to Rockingham by business partners or your telematics data collected with your permission.

To do this, please send an email to care@rockingham.insure requesting to review the information you provided us. If you believe that our information is incomplete or inaccurate, you can request that we correct it. Please note we may not be able to provide information relating to investigations, claims, litigation, and other matters. We will be happy to make corrections whenever possible. We will respond to all such requests within a reasonable timeframe.

Opt-out of marketing distribution. If you do not have, or no longer have a policy with us, or are no longer participating in the Pilot Program, you can contact us at care@rockingham.insure and request that we remove you from our marketing distribution lists. Please note that once you request removal, it may take up to 2 weeks to stop receiving email from us.

You have the right to know what information is collected, disclosed or shared about you. You also have the right to have this information deleted when permitted by law, and to opt out of the sharing of any information. Here we explain how this works.

Now that you are informed of the information we collect, disclose or share about you from this App and Pilot Program, you may have the right to delete this information. Certain information cannot be deleted because of legal and business reasons. We will inform you if this is the case after receiving a confirmation of your request to delete. Contact us at care@rockingham.insure to request deletion of your information. You also have the right to opt out of the practice of sharing your information with third parties for business or marketing purposes. Contact us at care@rockingham.insure to request to opt-out. If you are unable to make these requests yourself, you can appoint an authorized agent to do so by providing the authorized agent written permission. The agent can then contact us at care@rockingham.insure.

If you contact us via email, you will be required to provide verification with the following information:

• First and last name
• E-mail address

Any requests to delete information or opt out of sharing will not result in any discrimination of any kind.
